TCS Sydney Marathon presented by ASICS Competition - Terms and conditions

General

1. Name of promotional competition (Promotion)

a. Your Road to the 2026 TCS Sydney Marathon

2. Promoter

a. The Promoter is Transurban Limited ABN 96 098 143 410 of Tower Five, Collins Square, 727 Collins Street, Docklands VIC 3008, 03 8656 8900.

3. Promotion Period

a. Starts: 9am AEST, Thursday 28 August 2025

b. Ends: 4pm AEST, Saturday 30 August 2025

 

Who Can Enter

4. Entrants must:

a. be 18 years old or over; and

b. be a resident of Australia.

The following persons are ineligible:

a. directors and management of the Promoter;

b. directors, management and employees (and their respective Immediate Families) of the Promoter officers, employees, and contingent workers of the Promoter, Queensland Motorways Management Pty Ltd and Sydney Motorway Corporation Pty Ltd;

c. retailers, suppliers, associated companies, and agencies of the Promoter who are associated with this Promotion, and their directors, management and employees; and/or

d. retailers, suppliers, associated companies and agencies of the Promoter who are associated with this Promotion, and their directors, management and employees (and their respective Immediate Families).

e. The Promoter reserves the right to request verification of identity, residential address and any other information from any entrant or winner relevant to entry into, or participation in, the Promotion. Verification is at the discretion of the Promoter, whose decision is final.

Immediate Family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

 

How to enter

5. To enter, an eligible individual must, during the Promotion Period:

a. visit the Promoter’s branded activation stand located at the TCS Sydney Marathon Running Show presented by ASICS (14 Darling Drive, Sydney, NSW 2000 – ICC Darling Harbour) and scan the QR code and enter their details in the competition form; and

b. acknowledge you have read, understood and agree to the competition terms and conditions.

6. Limit on number of entries

a. An eligible participant can only enter the competition draw once.

7. An entry must be received by the Promoter by the end of the Promotion Period, or it will not be accepted. Entries are deemed to be received at the time of receipt by the Promoter, not at the time of transmission by the entrant.

8. The Promoter takes no responsibility should a person not have the software, hardware or mobile plan that permits access to, and use of, the method of entry. Any costs associated with accessing the internet, downloading data on a mobile device, or using any device to access and use the method of entry is the sole responsibility of the entrant and is dependent on the Internet/mobile service provider used.

9. To the extent permitted by law, the Promoter accepts no responsibility for:

a. any late, lost, or misdirected entries or other communications; or

b. any internet traffic congestion or problems with, or technical malfunction of, any hardware or software, including but not limited to any damage to the hardware or software of any entrant or other persons related to participation in the Promotion.

10. Entrants must not:

a. tamper with the entry process;

b. engage in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion;

c. use multiple aliases, email addresses, postal addresses, PO Box addresses and/or SIM cards to register multiple qualifying accounts or use any form of software or third party application to enter multiple times (including scripting software) except where expressly permitted in these Terms; and

d. engage in conduct in entering the Promotion which, in the opinion of Promoter, is fraudulent, misleading, deceptive, or generally damaging to the goodwill or reputation of the Promotion and/or Promoter.

11. The Promoter reserves the right to disqualify any individual who breaches these Terms, including but not limited to providing false information, failing to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering, or tampering with the Promotion.

12. Entries remain the property of the Promoter.

 

Prizes

13. There is a maximum of two (2) Prizes packages (each a Prize) for a total Prize pool value of up to $500

Each Prize package comprises of:

  • One (1x) Entry into the 2026 TCS Sydney Marathon presented by ASICS organised by Pont 3 (42KM event - full race) valued at $250 each.

14. If a winner ceases to meet the eligibility requirements set out in paragraph 4 after entering the Promotion and before the Prize is delivered, the Prize will be forfeited by the winner and cash will not be awarded in lieu of the Prize.

15. Unless expressly stated otherwise, Prize values are:

a. in Australian dollars; and

b. based on the recommended retail prices at the time of first publication of these Terms (inclusive of GST). The Promoter accepts no responsibility for change in Prize value between the time of first publication of these Terms and the ultimate Prize redemption date.

16. Prizes are not transferable, exchangeable and cannot be redeemed for cash. If a Prize or any element of a Prize is unavailable for any reason, the Promoter may substitute for that Prize, or an element of that Prize, another item of equal or higher value as determined by the Promoter (in its sole and absolute discretion).

17. Tax implications may arise from the receipt or use of a Prize. Independent financial advice should be sought.

 

Prize Specific Terms

18. General Prize Terms

2026 TCS Sydney Marathon presented by ASICS entry

a. Prize winners will receive one (1x) ticket into the 2026 TCS Sydney Marathon presented by ASICS (42KM event - full race) taking place on Sunday 30 August 2026.

b. Prize winners must complete their race registration with TCS Sydney Marathon presented by ASICS by 11:59pm AEST on 30 March 2026.

c. The Prize will expire if not booked or used by the date set out in paragraph 18(b) and can only be redeemed for the 2026 TCS Sydney Marathon presented by ASICS event.

d. The following are not included as part of the Prize: all out of pocket expenses involved in participating in the 2026 TCS Sydney Marathon presented by ASICS event including transport to and from the event, equipment, and all other costs. The costs of obtaining any of these requirements are the responsibility of the Prize winners.

e. A strict no cancellation/amendment policy applies once event registration has been made by 11:59pm AEST on 30 March 2026.

2026 TCS Sydney Marathon presented by ASICS Sponsor Entry Giveaway T&Cs

a. Under the 2026 TCS Sydney Marathon presented by ASICS Sponsor Entry Giveaway Terms and Conditions:

1) participants must register themselves using their name in accordance with their driver’s license or passport, and scan the QR code and enter their details in the competition form;

2) sponsors are not permitted to register on a participant's behalf under any circumstances;

3) participants must attend the TCS Sydney Marathon Running Show presented by ASICS with ID to personally collect their bib prior to event day;

4) prize winners should not enter the Candidacy Club application or General Ballot;

5) no refunds will be provided for duplicate registrations;

6) entries are non-refundable and non-transferrable (including name transfers, general deferrals to 2027 or downgrades to a shorter distance);

7) deferrals are only permitted to expectant parents under the Pregnancy and Postpartum Policy or to active Australian Defence Force personnel under our Defence Force Policy (terms and conditions apply); and

8) promotional codes (if applicable) must be entered into the relevant box prior to checkout. No refunds will be provided if the promotional code was not used during the registration process.

 

Prize Draw

19. A draw will take place at 4PM AEST, Monday 1 September 2025 (the Draw Date) at Transurban Limited, Tower Five, Collins Square, 727 Collins Street, Docklands VIC 3008.

20. On the Draw Date, the winners will be randomly drawn by an electronic draw process from all entries received during the Promotion Period. The first two (2) valid entries drawn will each win a Prize.

21. Limit applies of one (1) Prize per person.

 

How Winners will be Notified

22. Each Prize winner will be notified by phone call using the phone number on their entry within two (2) days of the Draw Date. The Promoter will then send an email to the winners with instructions to register for the 2026 TCS Sydney Marathon. Prize winners must confirm acceptance of their Prize during the phone call or by reply email.

23. The Promoter will make all reasonable attempts to identify and contact all Prize winners.

24. The Prize winner’s last name, initial of their first name, State and postcode will be published at https://www.transurban.com/sydney-marathon-competition-2025 on or before 5 September 2025 and will remain published for a minimum of 28 days.

25. Before the Prize transfer is made, each winner must attend a validation video call with an employee of the Promoter and show a form of valid photo identification that includes their full name and address. In the case that a Prize winner cannot verify their identity or residency; they will forfeit their right to the Prize. Each winner is solely responsible for ensuring their identity details are correct.

26. The Promoter will share a registration link for winners to register their details to confirm their place in the 2026 TCS Sydney Marathon presented by ASICS (42KM event - full race).

 

Second Chance Draw

27. Subject to applicable law, in the event that:

a. a Prize winner cannot be identified or contacted on or before 9am AEST Friday 5 September 2025, despite all reasonable attempts to do so by the Promoter; or

b. a Prize is unclaimed by that time for any other reason whatsoever (including because the winner has forfeited their right to the Prize, the winner does not accept and claim the Prize in accordance with paragraph 22, and/or the winner or the winning entry does not comply with these Terms, or otherwise),

c. the Promoter will conduct a second chance draw in order to determine a second chance winner (Second Chance Winner) for each unclaimed Prize. The second chance Prize draw will be conducted in the same manner as the original Prize draw (subject to any written directions from a regulatory authority).

28. If required, a second chance Prize draw will take place at 12pm AEST on Friday 5 September 2025 at Transurban Limited, Tower Five, Collins Square, 727 Collins Street, Docklands VIC 3008.

29. Each Second Chance Winner will be notified by phone call using the phone number on their entry within 2 days of the second chance draw date. The Promoter will then send an email to the winners with instructions to register for the 2026 TCS Sydney Marathon presented by ASICS event. Prize winners must confirm acceptance of their Prize during the phone call or by reply email.

30. If after a second chance draw any Prize remains unclaimed for any reason, the Promoter may dispose of the Prize as it sees fit (subject to any written directions from a regulatory authority).

31. The decision of the Promoter is final and binding; no correspondence will be entered into.

 

Personal Information

32. Details from your entry (being your first name, last name and email address) will be used for the purpose of conducting the Promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the Promotion), for promotional purposes surrounding the Promotion, and as otherwise set out in the Terms.

33. Details of Prize winners will be disclosed by the Promoter for the purpose of Prize fulfilment.

34. The two (2) Prize winner’s first name, last name, and email address will be disclosed to TCS Sydney Marathon.

35. Entrants’ personal information will be handled in accordance with the Promoter’s Privacy Policy, available at https://www.transurban.com/privacy

36. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s Privacy Policy by contacting the Promoter via email at privacy@transurban.com or phone at 13 33 31.

37. By entering the Promotion, entrants acknowledge that they have read and understood how their information will be used and disclosed by the Promoter and that this use and disclosure will be without any further reference or payment to the entrants.

 

Governing Law

38. The agreement which comes into force under these Terms is governed by, and must be construed in accordance with, the laws in force in Victoria and the Promoter and any consumer who participates in the Promotion submit to the non-exclusive jurisdiction of the courts of that State in respect of all matters arising out of or relating to these Terms, and the performance or subject matter of the Promotion.

 

Limitation of Liability

39. To the extent permitted by law, the Promoter (including its officers, employees and agents) will not be responsible for any acts of god, acts of terrorism or war (declared or undeclared), state of emergency, disaster, technical failures, security breaches, tampering, unauthorised intervention, fraud, computer viruses or other events beyond the Promoter’s control which affect the proper or reasonably anticipated conduct or administration of the Promotion, or prevent the awarding of the Prize in accordance with these Terms. If such an event occurs, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, subject to any written directions from a relevant regulatory authority.

40. Nothing in these Terms limits, excludes or modifies the statutory consumer guarantees provided under the Competition and Consumer Act 2010 (Cth), or any other implied warranties under any legislation in Australia. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including for negligence), for any personal injury or any loss or damage (whether direct, indirect, special or consequential) arising in any way out of the Promotion, including but not limited to where such injury, loss or damage arises out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Prize value to that stated in these Terms; (e) any tax liability incurred by an entrant or a winner; (f) participation in the Promotion or any component of the Prize by an entrant or a winner; (g) the conduct, act or omission of any service provider or Prize supplier associated with the Promotion; or (h) cancellation or postponement of any portion of the Prize for any reason beyond the reasonable control of the Promoter.
